Self-employed persons

The Business Immigration Program tries to attract experienced business people to Canada; people who will have positive contribution in development of a strong Canadian economy. There are three classes of business immigrants in Canada and for each class the criteria that applicant must meet to qualify are different as follow:

 
 
Investors
You may apply for permanent residence in Canada as an Investor if:
  • You have at least two years of business experience (i.e. you have either managed a qualifying business for at least 2 years in the period beginning five years before the date of application, or managed at least five full-time employees per year in a business for at least two years in the period beginning five years before the date of application, or a combination of these conditions). 
  • You have a net worth of at least C$800,000 - alone or with your accompanying spouse - that was lawfully obtained and are willing to make an investment of C$400,000 in Canada.  This money will be kept by the Canadian government and after five years will be returned to the investor. All the money is guaranteed by the Canadian government.
  • You must also show that you have enough money to support yourself and your dependants after you arrive in Canada.
  • You are able to obtain a minimum of 35 points in the business immigration selection point system.
  • You meet medical and security requirements.
 
Entrepreneurs
Experienced business persons who are able to own and manage a business in Canada can apply for permanent residence in Canada under the Entrepreneur category. To be qualified as an entrepreneur you must:
  • Have at least two years of business experience (i.e. you have managed a qualifying business for at least two years).
  • Have a net worth of at least C$300,000, alone or with your accompanying spouse, lawfully obtained.
  • Obtain a minimum of 35 points in the business immigration selection point system.
  • Meet medical, security and other requirements.
Permanent residency of entrepreneurs is conditional and they must comply with following conditions after arriving in Canada:
  • Must own at least 33 percent of the equity of a qualifying Canadian business;
  • Must provide active and on-going management of the qualifying Canadian business;
  • Must create at least one full-time job in the qualifying Canadian business for Canadian citizens or permanent residents, other than the entrepreneur and their family members.

These conditions must be fulfilled by entrepreneur for a period of at least one year within the period of three years after the day on which the entrepreneur becomes a permanent resident.

Self-employed persons
This type of business immigration is designed for persons who are able, and have intention, to become self-employed in Canada. Self-employed is a person who starts a business and creates job for him/herself.
Persons who have experience of self-employment in cultural activities or athletics, or persons who have farm management experience are eligible to apply for permanent residence in Canada under this category. People who participate at a world-class level in cultural activities or athletics are also eligible to apply as a self-employed. Like other applicants in business immigration class, self-employed persons also need to obtain a minimum of 35 points in the business immigration selection point system and must meet medical and security requirements.
 
 Required money after arriving in Canada
Applicants must show that they have enough money to support their self and their dependants after they arrive in Canada. This money can not be borrowed from another person. Proof of funds need to be provided to the Canadian visa office when applicants submit their application for immigration.
The size of family determines the amount of money as shown in the following table. These amounts are updated every year.
 
 
Qualifying Business
Qualifying business means a business which meets 2 of the following criteria during the year under consideration:
  • Employs at least 2 full time employees;
  • The total annual sale is equal to or greater than C$500,000;
  • The net income in the year is equal to or greater than C$50,000;
  • The net assets at the end of the year are equal to or greater than C$125,000.
Note that the above numbers are applicable for applicants who own 100 percent of the equity of the business. If applicant controls less than 100 percent of the equity, numbers will increase depending on the percentage of shares that you own:
 

 

Qualifying Canadian business
Qualifying Canadian business means a business which meets 2 of the following criteria during the year under consideration:
  • Employs at least 2 full time employees;
  • The total annual sale is equal to or greater than C$250,000;
  • The net income in the year is equal to or greater than C$25,000;
  • The net assets at the end of the year are equal to or greater than C$125,000.
Note that the above numbers are applicable for applicants who own 100 percent of the equity of the business. If applicant controls less than 100 percent of the equity, numbers will increase depending on the percentage of shares that you own:
 
 
Selection point system: business immigration
To apply for permanent residence in Canada under the business immigration category, you must obtain a minimum of 35 points in the selection point system. In this system you will be assessed against five selection criteria as follow (Click each factor to learn more about it):

Abilities in English and/or French
Applicants can score a maximum of 24 points for their abilities in English and/or French. If you have both English and French language skills you need to select one of these languages, the one that you are more comfortable in using, as your first official language. Then, the other language will be your second official language. If you are not familiar with either French or English you score points only for the first official language skills and you obtain no points for the second official language abilities.
Points are awarded based on the level of your language proficiency in reading, writing, listening and reading as follow:

Adaptability - Investors and Entrepreneurs
Investors and Entrepreneurs can obtain a maximum of 6 points for adaptability by any combination of the following elements.
